A student from Daulat Ram College filed a petition in the Delhi High Court seeking her result for fifth-semester exams which were held in December 2019. As per the student, she appeared for all four of her exams of the fifth semester but in the ‘International Trade’ exam which was held on 3rd December 2019, she got late due to traffic and in hurry, she mistakenly took some of her notes in her stationery pouch. But as soon as she realized it, she herself went to the invigilator to surrender her notes. Her exam was held void and she was given a new answer sheet, but almost when the exam time had concluded. While the invigilator has alleged her for cheating in the examination.
After the declaration of result of her batchmates, she issued a show-cause notice on 12th March 2020, where she mentioned that even after numerous representations to the University, there has been no response. No hearing took place before the University made the decision to cancel her examination and not declare her result.
On the other hand, according to the University, the student didn’t issue any show-cause notice or sought for any hearings. Due to lockdown, it has taken some time for the University to collect and retrieve records to put before the court.
The court, therefore, concluded that the complainant is a meritorious student in her final year and she was not given a hearing before making any decision. Thus, she can file a counter-affidavit against the University with necessary documents within two weeks. Also, the University must place her result for the other three exams in the next hearing on May 11.
